Penalties for drug convictions vary according to the type of drug and amount involved. Drugs fall under one of Texas' various penalty groups. These include:
- Possession of Marijuana: Less than 2 ounces, punishable by up to 180 days in jail and $2,000 fine; 2 to 4 ounces, up to one year, $4,000 fine; 4 ounces to 5 pounds, up to two years, $10,000 fine; 5 to 50 pounds, up to 10 years, $10,000 fine; 50 to 2,000 pounds, up to 20 years, $10,000 fine; more than 2,000 pounds, up to 99 years, $10,000 fine.
- Delivery of Marijuana: Less than 1/4 ounce with no payment, up to 180 days in jail, $2,000 fine; less than 1/4 ounce with payment, up to one year, $4,000 fine; 1/4 ounce to 5 pounds, up to two years, $10,000 fine; 50 to 2,000 pounds, up to 20 years, $10,000 fine; more than 2,000 pounds, up to 99 years, $10,000 fine.
- Penalty Group 1 and 1A: Includes methamphetamine, heroin, cocaine, and opioids such as oxycodone. Minimum sentence: 180 days to two years incarceration and fine up to $10,000 for possession of less than one gram. Maximum sentence: 15 years to life and a fine up to $250,000 for manufacture and delivery of more than 400 grams (.88 pounds).
- Penalty Group 2 and 2A: Includes synthetic cannabis, MDMA (Ecstasy), and psilocybin (mushrooms). Minimum sentence: same as Penalty Group 1 and 1A. Maximum sentence: 10 years to life and fine up to $100,000 for manufacture and delivery of more than 400 grams. Penalties lessen for synthetic cannabinoids.
- Penalty Group 3: Includes compounds containing prescription medications, including Ritalin, Xanax, Klonopin, and morphine. Minimum sentence: up to one year in jail and fine of $4,000 for possession less than one gram. Maximum sentence: same as Penalty Group 2 and 2A.
- Penalty Group 4: Includes compounds with limited quantities of drugs with non-narcotic medicinal ingredients, including codeine and morphine. Minimum sentence: up to 180 days in jail and $2,000 fine for possession of less than 28 grams. Maximum sentence: five years to life and fine up to $50,000 for more than 400 grams.
